Terms & Conditions
These Terms & Conditions outline the agreement between you (the client) and Eulonique. By engaging our services, you confirm your acceptance of these terms.
1. Scope of Service
Eulonique provides professionally written eulogies and funeral scripts, ensuring a personalised and meaningful tribute. In addition:
Optional storage refers to secure digital storage of the client’s documents via Eulonique’s Member Area, accessible to the client and up to two nominated account holders. This may incur an additional fee.
Updates to eulogies or scripts are provided according to the service level purchased and are only included while the client’s subscription remains active.
2. Revisions
Clients are entitled to unlimited revisions until they are satisfied with the final text.
Eulonique reserves the right to impose reasonable limits if revision requests become excessive, such as multiple major rewrites or ongoing weekly changes without new information.
3. Delivery Format
All work is delivered digitally in a format that best suits the client’s needs (e.g., Word, PDF).
Printed copies are included for UK-based clients unless otherwise stated.
Non-UK clients may request printed copies for an additional fee to cover international postage and handling.
Additional printed copies beyond the included one may also be available for an extra fee.
4. Client Responsibilities
Clients are responsible for reviewing and approving all text before use.
Eulonique cannot be held responsible for any inaccuracies in names, places, dates, or other personal details.
Eulonique will undertake reasonable research where needed; however, the accuracy of all personal details must ultimately be confirmed by the client.
5. Ownership & Copyright
The client retains full ownership of their final eulogy or funeral script.
Once delivered, the client is free to use, modify, or share the text as they see fit.
6. Payment Terms
Payment is required upfront for all services and is processed securely via Stripe.
In certain cases, a 50% deposit may be arranged, with the remaining balance due upon completion.
7. Cancellation Policy
Cancellations are not permitted once work has started.
Due to the personalised nature of the service, refunds cannot be issued once writing has begun.
By proceeding with payment, clients confirm their understanding and acceptance of this cancellation policy.
8. Additional Legacy Letters
The Everlasting Tribute Plan includes up to three legacy letters.
Additional letters can be provided for an extra fee, which will be agreed upon before work begins.
Pricing for extra letters will depend on length and complexity.
9. Ad-Hoc Updates Beyond Included Annual Revisions
Living Legacy Plan: Includes one hour of annual updates per year.
Everlasting Tribute Plan: Includes one hour of annual updates per year.
Any additional updates beyond these limits are charged at £75 per hour.
Clients will be notified if an update is expected to exceed their included time before any additional charges apply.
10. Service Discontinuation & Business Closure
In the event that Eulonique ceases operations, the following terms will apply:
Notification: Clients with active services will be notified as soon as reasonably possible.
Completed Services: Clients who have received their final eulogy or funeral script will retain full ownership and responsibility for safekeeping.
Annual Update Plans (Living Legacy Plan & Everlasting Tribute Plan):
If the closure occurs before an annual update has been provided, a pro-rata refund may be issued at Eulonique’s discretion.
If the closure occurs after an annual update has been provided, no refund will be due.
11. Digital Storage & Access:
Clients with stored digital copies will be given an opportunity to download their documents before the service is discontinued.
After closure, Eulonique will no longer store or update client files.
12. No Further Services
Following any closure of business operations, no further updates, revisions or support will be provided.
Eulonique is a trading name of James McCoy, Sole Trader, operating in the United Kingdom.
Disclaimer
1. Service Limitations
Eulonique provides writing services only. Eulonique does not offer:
Legal or financial advice.
Grief counselling or emotional support services.
Any guarantees regarding funeral planning, arrangements, or officiation.
2. Accuracy of Information
All content is based solely on information provided by the client, and Eulonique is not responsible for any inaccuracies in names, dates, locations, or other personal details.
Clients are solely responsible for reviewing and verifying the accuracy of all content before use.
3. Intended Use
The content provided by Eulonique is for personal use only and is not intended as legally binding documentation.
Clients are free to use, share, or modify their eulogy or funeral script as they see fit.
Privacy Policy
1. Data Collected
Eulonique collects and processes personal data with consent only for the purpose of communication and providing services. This may include:
Names, email addresses, and personal stories (for eulogy and funeral script creation).
Other information provided by the client as part of the service.
2. How Data is Stored
All data is stored securely in a cloud-based system.
Completed eulogies and funeral scripts are stored securely within Squarespace for client access.
3. Third-Party Data Sharing
Eulonique does not sell or share personal data for marketing purposes.
Payment processing services may collect and process financial details; a link to their privacy policy will be provided once selected.
If a printed copy is requested, a third-party printing service may require the client’s name and address for delivery. Their terms and privacy policy will apply.
Eulonique is not responsible for how third-party services handle or process data, and clients are encouraged to review their privacy policies directly.
4. GDPR Compliance & Client Rights
Clients have the right to access, update, or request deletion of their personal data at any time.
If a client wishes to have their information removed, they may contact Eulonique directly.
5. Data Retention
For services requiring annual updates, data will be retained for the duration of the service and until the client is known to be deceased. Thereafter, it will be stored for no more than three years.
Clients may request early deletion of their data at any time.
Refund & Cancellation Policy
1. Refunds
Refunds are allowed before writing begins.
Once work has started, refunds are not available due to the personalised nature of the service.
The cooling-off period will be confirmed during the onboarding process and documented in writing, based on availability and workload.
2. Changes After Delivery
Legacy Plan: No changes after final delivery, except by negotiation.
Living Legacy Plan & Everlasting Tribute Plan: Includes annual updates as part of the service.
3. Ongoing Subscriptions & Cancellations
If a client cancels an annual subscription (Living Legacy or Everlasting Tribute), they will receive the latest version of their eulogy or funeral script.
A final opportunity for minor edits will be provided before cancellation is confirmed.
No further changes will be possible after cancellation unless a new service agreement is established.
Additional Legal Considerations
1. Hard Copy Shipping Terms
If a printed copy is requested and fulfilled via a third-party service, the third party’s terms and conditions will apply.
Eulonique is not responsible for delays, damages, or issues arising from third-party print and shipping services.
2. Discontinuation of Service
If a service is discontinued, any current subscribers will be notified.
A mutual agreement will be reached to determine how their existing documents will be finalised or returned.
